Terms of Service

THESE TERMS OF SERVICE SET FORTH THE BINDING CONTRACTUAL TERMS FOR YOUR USE OF THE CLASH MOBILE APPLICATION AND RELATED SERVICES. PLEASE READ THEM CAREFULLY BEFORE CREATING AN ACCOUNT.

1. Acceptance of Terms & Eligibility

By downloading, installing, accessing, or using Clash, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all terms, you are prohibited from using the app.

• Age Minimum: You must be at least 13 years of age (or the legal age of digital consent in your jurisdiction). Minors between 13 and the legal age of majority must review these Terms with a parent or legal guardian.
• Legal Capacity: You represent and warrant that you have full legal capacity to enter into a binding agreement and are not barred from receiving services under applicable laws.

2. Account Registration, Rules & Security

• Account Creation: You must register using a valid Sign In with Apple account. You agree to provide accurate, current, and complete profile information.
• One Account Per Person: Users may maintain only one (1) active account. Creating multiple or fraudulent accounts to evade blocks, forfeits, or bans is strictly prohibited.
• Security Responsibility: You are solely responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. Notify us immediately of any unauthorized access.
• Account Termination: Clash reserves the right to suspend or permanently terminate accounts that violate these Terms, engaged in fraudulent behavior, or remain inactive for extended periods.

3. Challenge Mechanics & Self-Reporting Acknowledgment

Clash provides a platform for social challenges between users based on custom parameters:

• Rules Configuration: Participants mutually select challenge parameters, including duration, measurement target (e.g., Screen Time goal), and forfeit conditions.
• Self-Reported Results: Challenges rely on user self-reporting and mutual confirmation. Apple Screen Time APIs do NOT automatically declare winners or transmit usage totals to our servers. Users evaluate and confirm results mutually within the interface.
• Fair Play: Users agree to report challenge outcomes honestly and in good faith. falsifying results constitutes a breach of Community Conduct.

4. Penalty-Selfie Rules & Forfeit Content Standards

Users may elect to stake a "Penalty Selfie" as a stake for challenge loss. When uploading a Penalty Selfie, you warrant and agree that:

• Ownership & Authorization: You own all intellectual property rights in the selfie or have express written consent from any individual depicted.
• Strict Content Restrictions: You will NOT upload any image that contains:
  • Nudity, sexually explicit, suggestive, or pornographic material;
  • Depictions of violence, self-harm, weapons, illegal substances, or illegal acts;
  • Hate speech, harassment, bullying, intimidation, or discriminatory symbols;
  • Infringement upon any third-party copyright, trademark, privacy, or publicity right.

5. Limited User Content License

You retain ownership of the photos and content you submit to Clash. However, to operate the platform, you grant Clash a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, stream, transmit, reformat, and display your Penalty Selfie and profile media solely for the technical operation of the challenge and disclosure to your designated opponent pursuant to app rules. This license terminates when the content is permanently deleted from our servers.

6. Community Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited actions on Clash:

• Harassing, stalking, intimidating, threatening, or coercing any user;
• Uploading or sharing non-consensual intimate imagery (NCII) or targeted abuse;
• Impersonating any person, brand, entity, or fellow user;
• Using automated scripts, bots, scrapers, or exploits to tamper with challenge outcomes or app state;
• Attempting to bypass security controls, decrypt image vaults, or probe system vulnerabilities;
• Distributing spam, junk mail, chain letters, or commercial solicitations.

7. Reporting, Blocking, Moderation & Enforcement

Clash is committed to maintaining a safe environment:

• In-App Reporting & Blocking: Users can block abusive peers or report offensive profile content and Penalty Selfies directly via the in-app reporting tool.
• Enforcement Options: Clash moderators review reports and may take immediate action, including warning users, removing offending content, hiding revealed selfies, or issuing immediate temporary/permanent account bans.
• Reporting Desk: You may submit urgent violations directly to junjason1126@gmail.com.

8. Intellectual Property Rights

All rights, title, and interest in and to the Clash Service—including software, designs, trademarks, logos, code, UI design, and service layout—are the exclusive intellectual property of Clash Inc. Except as expressly permitted, you may not copy, reverse engineer, decompile, or create derivative works of our software.

9. Service Availability, Modifications & Termination

We strive for high uptime but do not guarantee uninterrupted availability. Clash reserves the right to modify, update, pause, or discontinue any app feature or the entire Service at any time without prior liability. We may suspend or terminate your access for violation of these Terms.

10. Important Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASH INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, DATA, USE, OR GOODWILL, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR OPPONENT, INCLUDING UNAUTHORIZED SCREENSHOTS OR DISTRIBUTION OF USER CONTENT; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

12. Indemnification

You agree to defend, indemnify, and hold harmless Clash Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to the Service, your User Content, your violation of these Terms, or your violation of any third-party right.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state or federal courts located in Delaware.

14. Privacy Policy & Account Deletion Process

Your privacy is vital to us. Please review our full Privacy Policy at https://clashofscreentime.vercel.app/privacy to understand our data practices.

Account Deletion: You may delete your account at any time within the app by navigating to Settings > Account > Delete Account. Upon deletion, your account details, pending challenges, and uploaded Penalty Selfies are permanently removed from active databases in accordance with our Privacy Policy.

15. Updates to Terms & Notice

We reserve the right to modify these Terms at any time. We will provide notice of material modifications by updating the Effective Date at the top of these Terms and delivering an in-app alert or notification email. Your continued use of Clash following notice constitutes acceptance of the revised Terms.
